TERMS OF USE AND SERVICES OF MEU GURU

To use Meu Guru's Platform, whether through the website or application, it is essential that you read, understand, and accept the terms established here, as well as the guidelines for the treatment of your personal data as described in our Privacy Policy.

By expressing your acceptance of these Terms of Use, you will be legally bound by all conditions and clauses present, as well as by the aspects contained in our Privacy Policy. If you do not agree with any of the mentioned regulations, we recommend that you do not accept these Terms of Use and, consequently, do not enter the Meu Guru Platform.

1. PARTIES

1.1. By accepting these Terms of Use and accessing our website or application, you, as an individual natural person, identified and previously registered on the Meu Guru Platform, hereinafter referred to as User and/or Student, establish a relationship with the company MG SOLUCOES DIGITAIS LTDA, a private legal entity, registered under CNPJ No. 42.269.770/0001-84, hereinafter referred to as Meu Guru.

2. DEFINITIONS

Meu Guru: refers to a teaching Platform that, in partnership with specialized and qualified teachers (tutors), provides the services of i) microtutoring, by enabling the quick and secure resolution of exercises and/or problems presented by students/users through the use of the provided Platform and direct assistance from tutors; ii) access to teaching materials from undergraduate/teaching degree courses at public higher educational institutions, facilitating users' access to study materials from their educational institution; iii) questions and answers through artificial intelligence, which allows students to clarify specific doubts about any points of academic disciplines through the Guru A.I. Platform, developed and controlled by Meu Guru.

Meu Guru Platforms: means, collectively:

  • The Meu Guru online Platform focused on better student learning, with emphasis on exercise resolution by previously registered tutors ('Resolution with Tutors')
  • The Meu Guru online Platform 'Study Materials' focused on document sharing
  • The Guru A.I. (Artificial Intelligence) Platform focused on quick answers in a 'forum' model
  • The Meu Guru Mobile Platform (Meu Guru App), which consists of the application for mobile devices, available for download on the Apple Store and Play Store

Site: Means our webpage Meu Guru.com/ or Meu Guru.com.br/ or Meu Guru.net.

Application: Consists of the application for mobile devices, available for download on the Apple Store and Play Store.

Student/User: Means any individual and legal entity that has registered through one of the Meu Guru Platforms to use the Platform's services, except for individuals and legal entities that intend to or perform a freelancer role on the Platform (tutor or 'guru').

Tutor: Means any individual and legal entity that intends to or performs a freelancer role on the Platform, responsible for direct assistance to students in resolving exercises and/or problems posted by them.

Account: User credential necessary to use Meu Guru's service, accessible by providing login (registered email) and password.

Social login: Refers to an authentication method where users use their social network accounts (such as Facebook, Google, Apple etc.) to log into third-party applications and websites, without the need to create a new account or specific password for that service.

Sharing: Action by the Student/user or Tutor/'guru' to enable third parties to access their Content hosted on the Meu Guru Platform.

Personal data: Refers to any detail that can identify or has the potential to identify an individual, including, but not limited to, full name, personal identification, CPF number, telephone or electronic contacts, residential or electronic address, business registration, professional credentials, geographic location, IP addresses, personal image, financial information and related items.

Scheduled resolution: Refers to the request for assistance in resolving exercises and/or problems that already has a defined deadline for delivery, such as exercise lists, assignments, projects and reports.

Live resolution: Refers to the request for assistance in resolving exercises and/or problems that has a short duration time for carrying out the activity (limited to 06 hours), which requires continuous communication between the tutor and the student/user. It is, therefore, a scheduling for real-time resolution.

3. ACCEPTANCE OF TERMS OF USE

If you do not agree with any of the conditions mentioned throughout these Terms of Use, we recommend that you do not agree with the rules established here and do not contract our services.

3.1. The responsibility for using the Meu Guru Platform (whether in the mobile web version or mobile app version) lies entirely with the user, requiring compliance with all current national legislation and the terms and policies published and updated by Meu Guru.

3.2. If you are under 18 (eighteen) years old, your parents or legal guardians will assume all obligations and responsibilities stipulated in these Terms of Use on your behalf.

3.2.1. If you are under 16 (sixteen) years old, your parents or legal guardians will be responsible for supervising your activities on the Meu Guru Platform, ensuring that the use of services mentioned in these Terms complies with the law and does not violate the rules and policies established by Meu Guru.

3.2.2. The same level of supervision mentioned above will apply if you are between 16 (sixteen) and 18 (eighteen) years old, so that your parents or legal guardians must provide assistance in using the Meu Guru Platform, as well as jointly consent to these Terms.

3.3. The registration and use of the Meu Guru Platform is individual and non-transferable, and use by more than one person is prohibited.

4. ACCOUNT REGISTRATION ON THE MEU GURU PLATFORM

In this topic, we detail the process by which the user can establish their account, as well as the responsibilities arising from registration. It should be noted that non-compliance with these provisions may result in account cancellation (see also topic Student/User Obligations).

4.1.You must provide Meu Guru with all personal data necessary for your registration on the Platform. If the provided data shows inaccuracies or is incomplete, making it difficult to confirm the user's identity, Meu Guru reserves the right to suspend the use of its services, being exempt from any responsibility.

4.1.1. Upon registration, the user freely, knowingly, and expressly agrees that the information provided during the registration process and/or originated from the use of the content is original and may be retained by Meu Guru and shared as follows: (i) with competent public authorities that formally request it; and (ii) with strategic, commercial, or technical partners.

4.2. By registering on the Meu Guru Platform and providing personal contact data, the user accepts to receive communications via e-mails, phone contact, text messages, WhatsApp, notifications in instant messaging applications, through push notifications from applications in general, or other electronic communications.

4.2.1. At any time, the user may choose to no longer receive communications of this nature, simply by:

4.2.1.1.In case of interruption of push notifications, choose such configuration in the application itself in the "Manage notifications" tab or similar.

4.2.1.2. In case of interruption of e-mail reception, cancel through the e-mail itself in the hyperlink "I would not like to receive more e-mails" or similar;

4.2.1.3. In case of interruption of communications through other channels, contact support to be removed from the contact base.

4.3. It is the user's total responsibility to provide Meu Guru with correct, complete, and truthful personal data for proper registration. If this obligation is not fulfilled, your Meu Guru account may be permanently canceled, after prior notice or notification.

4.3.1. Under no circumstances are you authorized to impersonate another natural or legal person, alter your identity, or create false association with any individual or entity.

4.4. Through the completion of your registration, as well as the acceptance of the Terms set forth here, you become fully responsible for the use of Meu Guru's services in your name, through your personal password, and for all activities carried out within your account. This responsibility includes, but is not limited to, obligations, demands, and questions resulting from the use of the account, so that you must take all necessary measures to keep any personal and confidential information secret.

4.5. Due to the complexity and impossibility of exemption from failures in the computer system, by its very nature, you, or, when applicable, your parents or legal guardians, agree that Meu Guru will not be held responsible for invasions or changes in your account resulting from the use of new tracking techniques not detectable by the security systems adopted by Meu Guru, including, but not limited to, hackers or crackers, with Meu Guru committing to make the best efforts to prevent invasions and/or changes in your account.

4.6. By registering with Meu Guru, the user accepts that, for unlimited use of products involving subscription (Guru A.I. and Study Materials), they will have to acquire one of the plans (monthly, quarterly, or annual), under the terms proposed on the website.

4.7. Similarly, the user understands and accepts that the amount paid for the contracted plan (R$50.00 for the monthly plan; R$130.00 for the quarterly plan; and R$215.00 for the annual plan) will be integrated into their account as bonus credits to be used for contracting the "Resolution with Tutors" services provided by Meu Guru tutors on a one-time and first-time basis, meaning that values related to plan renewals will not be added. Payments made for "Resolution with Tutors" services through bonus credits will only allow refunds in this same modality.

5. RESOLUTION SERVICES PROVIDED BY MEU GURU – "MENTORING"

5.1 The user may request the completion of a specific activity in the scheduled resolution or live mode, as specified in the Definitions item. This service can be purchased individually or within plans (monthly, quarterly, and annual), through payment under the terms outlined below.

5.1.1. When placing the order, with or without indicating the amount they intend to pay, the user may receive proposals from freelancers/tutors/gurus previously registered and qualified at Meu Guru. It is clarified that the hiring already includes the services provided by Meu Guru, which corresponds to up to 60% (sixty percent) of the amount agreed between the parties.

5.1.1.1. The fee charged by the Platform is due to the provision of the following services:

a) Maintenance and use of the demand management Platform, aiming to ensure a secure and intuitive environment: Meu Guru invests in the continuous maintenance and improvement of the Platform, which involves development and infrastructure costs;

b) Acquisition of new demands through investments in marketing and advertising: Meu Guru constantly seeks new collaboration opportunities for our gurus, expanding the number of demands and, consequently, service possibilities;

c) Security regarding demands: Meu Guru implements measures to ensure the security of demands shared on the Platform, ensuring that only properly qualified gurus have access to information after going through a rigorous selection process;

d) Conflict mediator: in addition to providing a reliable Platform for finding demands and projects, Meu Guru offers assistance related to payments and mediation in any conflicts that may arise between gurus and students, always seeking a fair and satisfactory resolution for both parties;

e) Guarantees in the use of the Platform and the service provided: by using the Meu Guru Platform, students have the guarantee of a secure environment and protected transactions. Additionally, Meu Guru offers customer support every day of the week to resolve any questions or problems that may arise during the process.

5.1.1.2. Meu Guru does not commit to sending tutor proposals for all orders submitted by students, as the decision to carry out or not a specific demand is a free and unimpeded choice of each freelancer.

5.1.1.3. Meu Guru tutors go through objective selection processes, which may include phases of curriculum analysis, technical assessment, preliminary interview, and group interview. Thus, if the tutor chosen by the user, due to issues beyond their will, with justification submitted to Meu Guru, cannot complete the accepted order, Meu Guru may direct the student's order to another tutor of equal competence in the subject in question.

5.1.1.4. The services provided constitute a best-effort obligation, meaning that Meu Guru is not liable for any eventual dissatisfaction of students, but only for employing all means at its disposal for better service delivery, including providing an interface for dispute (refund) to the user within 7 (seven) days after delivery of the resolution.

5.1.1.5. The responsibility for sending materials for analysis of exercises and/or problems lies with the student, which means that if a material is delivered incompletely/illegibly/inadequately, the tutor will limit themselves to providing assistance in the resolution in the most plausible way possible, and the student may not question any eventual incompleteness of the resolution if it results from incomplete submission.

5.1.2. It is strictly prohibited to attempt to contract resolution assistance services (teaching by resolution) for the purpose of performing any type of public examination and/or selection process, as well as any evaluative academic activity, under penalty of service interruption and adoption of all pertinent legal measures, as well as official communication to the competent institutions.

5.1.3. All contact between student and tutor must be made on the Meu Guru Platform, and it is forbidden for any of the parties to recruit services/clients through the Platform, as well as share personal data for external communication purposes, under penalty of account deletion with full retention of the amount paid for the order (non-refundable) under justification of payment of company operational costs for monitoring chats and orders, software and infrastructure costs.

5.1.3.1. Meu Guru is not responsible for projects closed outside the Platform, even when the initial contact occurs within it, given that external negotiation between student and tutor is a violation of these Terms.

5.1.4. Any questions regarding the orders published by the student must be sent directly to the tutor chosen for resolution, through the Meu Guru messaging system ("Chat").

5.1.4.1 Meu Guru will designate a responsible employee to monitor the "Chat" between tutor and student, aiming to resolve any technical or other problems that may arise during the execution of the order and inspection to prevent contact sharing between the parties.

5.1.4.2. The "chat" will be available for up to 07 (seven) days after the time of delivery of the order, in order to allow the student and tutor to address any inconsistencies observed in the resolution or clarify doubts about the delivered resolution. If there is a need to extend the chat availability time so that all doubts are resolved, simply contact the official Meu Guru support on WhatsApp so that the chat can be reopened for a limited time.

5.1.5. The user agrees with the granting of a 15 (fifteen) minute tolerance period at the stipulated time for delivery of the contracted resolution, except in cases where there is:

5.1.5.1. Consensus between user and tutor for advancement of the deadline through the platform chat;

5.1.5.2. Proof of impossibility of executing the service within the duration stipulated by the user in the hiring, in the case of a "live resolution", by the re-evaluators in a dispute process.

5.2. The hiring of the service is considered valid from the confirmation of payment of the agreed amount for the execution of the order, being, therefore, the initial milestone of the service provision contract entered into between the student and the tutor.

5.2.1. Meu Guru services are offered in prepaid format, which means that users must make the payment for the service before the "chat" is released for contact with the hired guru, as well as the start of the order resolution.

5.2.2. Payment can be made by credit card, PIX, PicPay, PayPal, bank slip, bonus credit available on the Platform, as well as other payment methods that may be included on the website, without prejudice to some of those indicated here being discontinued in favor of others. Payment made via bank slip may take up to 02 (two) business days to be compensated in the company's account, which is why, when there is a need for immediate start of the order execution, it is suggested that payment be made by another available method. Thus, it is reinforced that Meu Guru is not responsible for the delay in sending the resolution, due to the bank slip compensation period or other payment methods.

5.3. Meu Guru is allowed, after 30 (thirty) days of providing the contracted resolution, to make it available in the "Study Materials" tab for consultation by users, in a limited way, and other subscribers, in an unlimited way.

6. ARTIFICIAL INTELLIGENCE "GURU AI"

6.1. Guru AI is an artificial intelligence of Meu Guru, intended for resolving user questions for knowledge formation purposes. Through Guru AI, the user can ask questions, as well as see the questions and answers of other Platform users.

6.2. To view the answers of other users, given by Guru AI, the student must be registered on the Platform. Unlimited access to the product occurs only through the subscription of one of the Premium plans (monthly, quarterly, or annual).

6.3.The answers can be evaluated by students, as well as can be reported by them through the official Meu Guru support on WhatsApp, and the company reserves the right to remove the question in question, as well as take appropriate measures, if applicable. Possible reasons include:

a) Presence of requests for links or scan, link to external site, referral link, etc.;

b) Inappropriate questions, due to lack of content, incompleteness, logic, etc.;

c) Presence of offensive content such as swear words, adult content, etc.;

d) Presence of advertising.

7. STUDY MATERIALS

7.1. The "Study Materials" product is a tab for organizing academic materials, fed by the students themselves and organized by Meu Guru, as well as eventually formed by question resolutions and materials produced by the contracted microtutoring services ("Resolution with Tutors") by each user.

7.1.1. Access to materials in the "STUDY MATERIALS" tab is free in a limited way. For subscribing users, access to study materials is unlimited;

7.1.2. The user, subscriber or not, or when applicable, their legal guardians, will keep Meu Guru and its partners free and exempt from any responsibility regarding the Content posted by the User and hosted in the "Study Materials" tab, assuming all burdens and charges that Meu Guru may eventually have due to demands or complaints. Any demand, whether material, moral, or criminal, filed against Meu Guru and related to the content posted by the User, must be assumed exclusively by the User and, when applicable, their legal guardians.

a) Exam (assessment, test, AOL, AV, mock exam, questionnaire);

b) Exercise List (exercise, activity, pre-test);

c) Assignment;

d) Summary and Review (mind map, notebook photo, file);

e) Power Point (class, presentation, explanations);

f) General essays and articles;

g) Report;

h) Question resolutions from contracted microtutoring services.

7.2. Users are allowed to share content, as long as it does not infringe any clause of these Terms or our Privacy Policy. It is total responsibility of the user or their legal guardians to ensure that the content posted by them or any information inserted by them on the Platform is permitted and truthful, and should not be illegal, contrary to Meu Guru's rules and policies, or infringing on third-party rights.

7.2.1. The user, subscriber or not, or when applicable, their legal guardians, will keep Meu Guru and its partners free and exempt from any responsibility regarding the Content posted by the User and hosted in the "Study Materials" tab, assuming all burdens and charges that Meu Guru may eventually have due to demands or complaints. Any demand, whether material, moral, or criminal, filed against Meu Guru and related to the content posted by the User, must be assumed exclusively by the User and, when applicable, their legal guardians.

7.2.2. The user must refrain from practices that may cause any damage and/or harm to the intellectual property rights of Meu Guru and third parties. If Meu Guru is extrajudicially or judicially demanded by third parties due to any allegation of plagiarism, improper use of copyrighted work, violation of image rights and industrial property, the user who caused the complaint is obliged to indemnify, defend and keep Meu Guru exempt and pay or reimburse Meu Guru for any damage actually incurred.

7.2.3. By sharing 10 (ten) contents, approved by Meu Guru and made available on the Platform, users, subscribers or not, will be contemplated with a monthly plan (in the case of subscribers, with the extension to the previously adhered plan), free of charge.

7.3. Meu Guru acts as a mere organizer of materials, whether those made available by users or eventually from microtutoring resolutions, so that it is not responsible for the content of such documents, nor does it guarantee the publication of the material made available by the student.

7.4. The material can be evaluated by the student, as well as can be reported by them through an icon available on the Platform itself, in cases where it is observed:

a) Presence of incorrect information, such as material title not related to content, incorrect marking of subject, course or institutions, etc.;

b) Low quality of material;

c) Absence of answers or incorrect answers;

d) Violation of rights, such as the presence of inappropriate content, publication of material from another author, etc.

7.4.1. Meu Guru is not responsible for previously inspecting the user's content, however, it will evaluate the complaints, as well as take appropriate measures, through the removal of inappropriate material, removal of those responsible for sending the content and communication to the competent authorities, when applicable.

7.5. The user declares that they are aware that Meu Guru may, at any time and without prior notice:

a) Remove any content published by users, subscribers or not, or from microtutoring exercise resolutions, if this content infringes the conditions described in these terms of use, without this implying any type of retribution or need for consent on the part of the user;

b) Warn the user, subscriber or not, as well as suspend, even permanently, their access to the Platform, if their conduct violates the conditions provided for in these Terms of Use.

8. MEU GURU OBLIGATIONS

8.1. The following are Meu Guru's obligations:

a) Make available a Platform with related technology so that users can connect with online tutors through a text interface, as well as conduct the transaction through a text interface, as requested by users;

b) Carry out, continuously, selection processes for recruiting tutors, which may contain phases of curriculum analysis, technical assessment, preliminary interview, and group interview;

c) Provide permanent connection of Servers intended for services provided by Meu Guru, so that you can access the Meu Guru Platform at any time and in any place, except in situations of service interruption due to technical issues, fortuitous case, or force majeure;

d) Provide Technical monitoring Services by qualified technicians;

e) Ensure the maintenance of the quality of assistance provided by tutors to students, prioritizing the best possible learning process;

f) Interrupt or suspend the Services, or access to Products, if there is:

i) maintenance of a technical/operational nature;

ii) fortuitous cases or force majeure;

iii) actions by third parties that prevent the provision of services;;

iv) interruption or suspension of public utility services.

v) interruption or suspension of public utility services.

8.2. Meu Guru is not responsible for any damages or losses resulting from system interruptions in the cases provided for in the previous clause, or, still, resulting from causes for which it did not directly contribute.

8.3. Meu Guru does not guarantee the identity, integrity, and sincerity of freelancers/tutors and users/students, but is committed to verifying the veracity of the information offered, if there is any suspicion of fraud.

8.4. Meu Guru is committed to employing all necessary security measures to protect the personal data of registered students and tutors, as provided for in the Privacy Policies.

8.5 Meu Guru is committed to returning the full amount paid by the student, if the requested resolution presents an accuracy rate below 60% (sixty percent) and is properly validated and granted by the professional related to the order or by the internal team of re-evaluators. The refund request must observe the rules set forth in these terms, such as opening the request within a maximum period of 7 (seven) days after the date of delivery of the order.

8.5.1. The accuracy rate is not linked to the evaluation of the student's academic institution or other third parties, but rather to how much the presented resolution is conceptually adequate, under the conditions described above.

9. STUDENT/USER OBLIGATIONS

Below are the requirements for using the services by users who, if they do not comply, will not be able to use the Meu Guru Platforms.

9.1. By accepting these Terms of Use you declare that:

a) You acknowledge that these Terms of Use are formalized, binding the parties, with your electronic acceptance, which will occur through registration on the Meu Guru Platforms;

b) You have read and are aware of all terms and conditions of these Terms of Use and the Privacy Policy;

c) You will not request the performance of a service whose resolution is prohibited by these Terms of Use, including, but not limited to, requesting the resolution of evaluative activities, which do not allow consultation, public or private selection processes in general;

d) You will not create and will not encourage the creation by other users of profiles with names, descriptions, and/or profile photos considered obscene and/or inappropriate, including, but not limited to, nudity, sexual content, violence, criminal practices, incitement to criminal practice or violent acts, death, among others that violate Meu Guru's guidelines and current legislation;

e) You will exonerate Meu Guru from any legal proceedings resulting from your illegal use of the Platforms and, if necessary, will indemnify for losses and damages resulting from them;

f) You will not collect content or personal data from other users or tutors and will not access the Meu Guru Platforms using automated means, such as, for example, collection bots, robots, spiders, or scrapers;

g)You will not disseminate illegal multi-level marketing on the Meu Guru Platforms, such as, for example, "pyramid scheme";

h) You will not use Meu Guru's services or products to send/disclose any types of viruses or that may cause damage to your recipient or third parties;

i) You will not request private information, such as login and password, from other users and/or tutors, as well as will not access accounts that do not belong to you;

j) You will not intimidate, harass, or practice bullying against any user, tutor, and/or company employee;

k) You are over 18 (eighteen) years old, or a minor properly represented/assisted by your parents or legal guardians, in accordance with these Terms of Use and as per the law;

l) You will not use Meu Guru's services and/or products for the purpose of disrespecting the law, morals, good customs, Applicable Intellectual Property Legislation, and the General Data Protection Law;

m) You will not use Meu Guru's services or products to propagate illegal, defamatory material that violates the privacy of third parties or that is abusive, threatening, obscene, harmful, vulgar, injurious, or that in any other way violates third-party rights;

n) You will not send unsolicited messages, recognized as spam, junk mail, or chain letters;

o) You will be solely responsible for the content that you will convey and disclose on the Meu Guru Platforms and for the content ceded to Meu Guru, under the terms provided here;

p) You will not take any action that may disable, overload, interrupt, or prevent the services, or the servers or networks connected to the services and products made available by the Meu Guru Platforms;

q) Your account may be canceled and balance retained (without possibility of refund) if Meu Guru becomes aware, by itself or by third parties, of violations of the Terms of Use or applicable laws;

r) You will comply with all procedures, policies, rules, and regulations of Meu Guru and its Partners, as applicable; and

s) You must observe the existence of any legal or contractual impediment to which you may eventually be subject.

9.2. Your login and password are private and of your exclusive responsibility, and cannot be transferred, assigned, lent, commercialized, or shared with third parties. Thus, you assume all and any responsibility for the use of your login and password, and for actions taken in your account, as well as for any conduct that may harm systems or, still, for actions that are in disagreement with current legislation, being responsible for all losses and economic charges resulting from such practices.

9.3. You must prevent the loss of your Personal Data and the improper use of your account, keeping your login and password inaccessible to third parties. Consequently, Meu Guru shall not be held liable for incidents arising such situations, in accordance with Art. 14, § 3º, II of the Consumer Defense Code.

9.4. You declare that you are aware that all services and products of Meu Guru's Platforms to which you have Access will be for your sole and exclusive use, and it is not permitted to commercialize them, assign them to third parties under any title, or exploit them economically in any way, under penalty of cancellation of your account and blocking of future access, without prejudice to the responsibility for losses and damages caused to Meu Guru and/or third parties involved.

9.5. When placing an order for resolution in "Resolution with Tutors", the student commits to attaching all necessary information for the service to be performed, as well as verifying any inconsistencies or indications of plagiarism in the material sent, understanding that the non-fulfillment of such obligations prevents them from claiming any refund for incompleteness of the resolution or presence of inconsistencies/indications of plagiarism in the resolution, respectively.

9.6. The following constitute reasons for expulsion or removal of the student:

a) Inserting personal information in resolution requests so that the tutor contacts the student outside the platform;

b) Inserting personal information in the "chat" so that the tutor contacts the student externally to the Meu Guru Platforms;

c) Disrespecting tutors or the Meu Guru Team;

d) Virtually stalking tutors or any platform employee;

e) Requesting an order for selection processes of any nature and/or public competitions.

10. VALIDITY AND TERMINATION OF TERMS OF USE

Below we highlight information about validity and what are the hypotheses for immediate termination of these Terms of Use.

10.1. These Terms of Use come into effect on the date of your registration.

10.2. The Terms of Use may be terminated, by operation of law, regardless of any notification or interpellation, judicial or extrajudicial, in the following cases:

a) For breach of any provisions of these Terms of Use, by any of the parties;

b) If you, in any way, compromise the public image of Meu Guru;

c) If you perform acts that disrespect the law, public order, morals, good customs or, still, our Privacy Policy;

d) For non-payment of any remuneration due to Meu Guru;

e) If Meu Guru is unable to verify or authenticate any information provided by the user.

10.2.1. The Terms of Use may also be terminated if Meu Guru decides to discontinue the account, service, or product, in whole or in part, in which case prior communication of such discontinuity must be made to the user, with 30 (thirty) days notice.

10.3. In case of termination of these Terms of Use, for any reason, the parties commit to settle and liquidate, immediately, any existing debts and pending matters, related to services already provided and Products already used and not yet paid, if applicable.

10.4. In any case of registration exclusion present in these Terms of Use, Meu Guru may proceed with the deletion of all your information, Personal Data and materials, except for information that may or must be maintained under the terms of current legislation and provided for in our Privacy Policy, being the exclusive responsibility of the user to backup and save all information, data and materials linked to their account.

10.4.1. Meu Guru may also deny future registration if you have had your account terminated, due to one or more hypotheses provided for in clause 10.2 and/or 9.6.

11. UPDATES TO TERMS OF USE

11.1. Meu Guru may update these Terms of Use at any time, communicating the user by email, phone contact, text messages, WhatsApp, notifications in instant messaging applications, by push notifications in general applications, on Meu Guru Platforms, or other electronic communications.

11.2. The user may terminate the contract at any time, by deleting their account and, if they do not do so, their tacit acceptance of the communicated update will be considered.

11.3.Continued use of Meu Guru Platforms will imply your acceptance of such changes to Meu Guru's Terms of Use.

12. SUPPORT CHANNEL

Provisions regarding channels and ways to contact Meu Guru for questions, complaints, and general requests.

12.1 Meu Guru Support is conducted via WhatsApp messaging application, available for service during business days, between 09h and 20h, and during Saturdays and Sundays, between 10h and 17h.

12.2. The platform's Support channel has a deadline of up to 24 (twenty-four) hours for general responses.

13. RIGHT TO CANCEL IN "RESOLUTION WITH TUTORS"

13.1 The right to cancel from hiring may be exercised within the period of 10% (ten percent) of the equivalent time for delivery of the contracted material, limited to a period of 24h (twenty-four hours). Thus, if the user contracts a resolution for delivery with a deadline of 05 (five) days, for example, they may withdraw from the order within a maximum period of 12h. For activities with deadlines longer than 10 (ten) days, the right of withdrawal may be exercised in the first 24 (twenty-four) hours after hiring.

13.1.1. The refund procedure for values related to orders that were subject to withdrawal is provided for in the Refund Topic in Resolution with Tutors.

13.1.2. The exercise of the right to cancel is linked to the absence of delivery of the resolution material by the tutor to prevent this right from being used as a mechanism to receive free service provision. Thus, the delivery of final resolution by the tutor, even if before the deadline for exercising the right of withdrawal, prevents the user from using this prerogative.

14. CANCELLATION OF "PREMIUM SUBSCRIPTION"

14.1 The request for cancellation of the Premium subscription can be made through the web mobile platform itself, through stores (Google Play and App Store) or through Meu Guru's official support on WhatsApp with reduced hours compared to other company support matters, from 09h to 17h, Monday to Friday (business days). It should be noted that charges already made are not subject to refund in cases of renewal. In cases of first subscription charge, the provisions of the Refund Topic in Premium Subscription apply.

15. REFUND IN "RESOLUTION WITH TUTORS"

15.1. The following constitute cases for full refund:

a) The total distortion of the activity, characterized by the delivery of the final resolution of material completely different from that requested by the constant user;

b) Non-compliance with the delivery deadline and/or non-delivery of the contracted resolution, provided that the deadline has been exceeded by more than 15 (fifteen) minutes of delay, according to tolerance policy already established in these Terms (Item 5.2);

c) Delivery of the resolution in incomplete form, provided that the necessary information has been provided for the complete completion of the proposed order;

d) The resolution containing assertiveness below 60% (sixty percent);

e) Presence of conceptual errors that result in the total loss of the activity, characterized as those that distance themselves from the assertive way of resolving the request;

f) The presence of plagiarism or use of artificial intelligence in the delivered material, provided that this situation is noticed by the student at the time of final delivery of the contracted resolution.

§1° Material completely different from the requested is considered that in which the delivery of a different product from the required is observed.

§2º The assertiveness rate is not linked to the evaluation of the student's academic institution, but rather to how much the presented resolution is conceptually adequate.

§3º A resolution is considered incomplete when it fails to provide any item or request expressly made by the student in the order.

The delivery of identical material for the same students is not considered plagiarism, since what must be observed is whether the activity is conceptually adequate for each case, meeting the particularities and doubts of each student.

15.1.1. The hypotheses listed in cases of integral restitution of paid values are taxative.

15.1.2. For refund purposes, it is up to the user to send the resolution of the activity in which any of the hypotheses listed in item 14.1 was found, under penalty of the complaint being disregarded. This is because it is necessary to question the wrong points of the resolution specifically.

15.2. From the date of the refund request, the counterpart (tutor) has a period of 7 (seven) calendar days for analysis. If they agree with the student/user's request, the process is closed and the withdrawal can be used on the platform or refunded (in case there has been contact sharing between the parties, the refund will be applied as balance on the platform). If there is no agreement between the parties, it is up to independent revaluers to analyze the situation and final opinion. The total time of the dispute, after opening the request, is up to 21 (twenty-one) calendar days and will be better described in the Dispute Process Topic.

15.3. Payments made through bonus credits will only allow refund in this same modality, as already clarified in item 4.7. The impossibility of refunding a subscription, whatever its Premium plans (monthly, quarterly or annual), for withdrawal is reiterated. If reason is attested for a refund derived from the "Resolution with Tutors" service, the related value will be disposed for exclusive use on the platform in other orders of the same type of service. In case of sharing personal data by the student/user, the value may be retained (not refunded). Similarly, if the refund dispute is not approved, the refund derived from subscription bonus credits will not be applied. The two situations mentioned extend to the legal withdrawal period of 7 (seven) days, this because it refers to the provision of services by a professional, with Meu Guru platform having to transfer the payment to the professional and/or cover software, infrastructure and operational expenses.

16. REFUND IN "PREMIUM SUBSCRIPTION"

16.1 For subscribing users who do not use the "Resolution with Tutors" services, the right to refund applies only if the request is made within 7 (seven) days after contracting through Meu Guru's official support on WhatsApp, in situations of:

a) No questions sent to the "Guru A.I." service and no material downloaded in the "Study Materials" service, with application of full refund;

b) Less than 10 (ten) questions sent to the "Guru A.I." service and no material downloaded in the "Study Materials" service, with application of partial refund.

§1° Users who have sent 10 (ten) or more questions to the "Guru A.I." service and/or downloaded any "Study Material" within or outside the 7 (seven) day request period are considered barred from the right to refund. Additionally, as suggested above, users who have partially or fully used bonus credits from the Premium subscription for the "Resolution with Tutors" service are not entitled to a refund.

17. INTELLECTUAL PROPERTY OF RESOLUTIONS CARRIED OUT THROUGH THE MEU GURU PLATFORM

Below, we specify the Intellectual Property rights of the content made available by Users on the Meu Guru Platforms.

17.1. Meu Guru holds all intellectual property rights related to the Meu Guru Platforms, including, but not limited to, resolutions contracted by Users and which are assigned, hereby, expressly to Meu Guru, free of charge, such as, but not limited to, texts, graphics, images, videos, sounds, illustrations, computer programs, source codes, trademarks, slogans, domain names, databases, business names, logos, icons, image set (trade dress), as well as the selection and organization of these elements.

17.2. The user's acceptance of these Terms of Use consists only of the grant, by Meu Guru, of a limited, temporary, revocable, non-exclusive, and non-transferable license to use the Meu Guru Platforms. Therefore, you will not acquire any right of use, license, or assignment of intellectual property other than those expressly provided for in these Terms.

17.3. All texts, icons, systems, programs, content, organization, messages, images or any other identification that are authored/owned by third parties and published on the Meu Guru Platforms, with the authorization of their respective authors/owners, are protected by the Applicable Intellectual Property Legislation.

17.4. The user must refrain from practices that may cause any damage and/or harm to Meu Guru's intellectual property rights and the operation of the Server(s), including, but not limited to, the use of any programs that may cause this effect, under penalty of immediate suspension and/or cancellation of the user's account.

17.5. If Meu Guru is extrajudicially or judicially demanded by third parties due to any allegation of plagiarism, improper use of copyrighted work, violation of image rights and industrial property, the User who caused the complaint is obliged to indemnify, defend and keep Meu Guru exempt and pay or reimburse the company for any damage actually incurred.

17.6 The contracting user is aware that the requested support material is not their exclusivity; which means there is no impediment for the same material to be used to support another contracting user.

18. CREDITS AND COUPONS

18.1. The user acknowledges that the acquisition of credits or pre-paid service packages is an independent and separate transaction from the specific services that will be used later on the Meu Guru Platforms.

19. DISPUTE PROCESS

19.1. In case of suspicion of occurrence of any of the hypotheses provided for in item 14.1, the student may open a dispute process to receive a refund of the amount invested to obtain a certain resolution.

19.1.1. When entering the dispute process, the student must inform what value they consider valid and the reasons they understand that give rise to the refund.

19.1.1.1. The deadline for opening the dispute process is 07 (seven) days, counted from the receipt of the resolution on the website.

19.1.2. The tutor responsible for the demand will be notified to respond whether they agree with the reasons presented by the student for refund, and they may make a counter-proposal, or deny the student's right, by exposing the reasons why they consider there is no reason for the request.

19.1.2.1. The tutor has a period of 07 (seven) days to present responses, counted from the student's request, under penalty of the student's allegations being considered true.

19.1.3. If the tutor accepts the student's refund request, the process is closed and the refund process begins, with the student being responsible for applying the balance obtained from the process in new orders on the platform or requesting the withdrawal. After requested, Meu Guru is responsible for releasing the amount within 48 (forty-eight) business hours. It is important to note that after the release action, the contractor's bank is responsible for refunding the values. In cases of payment via PIX, Picpay or Paypal, the values are usually released immediately. In cases of credit card payments, the values may be compensated within 15 (fifteen) days, with Meu Guru being responsible only for sending the proof of release operation performed to the user, after request through the company's official support on WhatsApp.

19.1.4 If the tutor presents a counter-proposal or completely denies the student's right to refund, the student will be notified of the tutor's opinion, and may accept the counter-proposal or not.

19.1.4.1. The student has a period of 07 (seven) days to respond to the tutor's response, counted from the student's request, under penalty of the tutor's allegations being considered true and/or the counter-proposal being accepted.

19.2. In the absence of consensus between the parties about the occurrence or not of any of the hypotheses that give rise to refund, the process will be forwarded to 02 (two) independent tutors in the area for an opinion.

19.2.1. Independent tutors must analyze the dispute process, as well as all contact made between tutor and student during the preparation of the resolution, in order to observe if there was a situation capable of giving rise to refund, as well as if it is a case of full or partial refund (and in this case, what percentage is due).

19.2.2. If there is a discrepancy between the opinions of the independent tutors, a third tutor is invited to participate in the process, for the purpose of breaking the tie.

19.2.3. The deadline for evaluating the dispute process and issuing an opinion by independent tutors is 07 (seven) days, counted from the submission of the material by Meu Guru.

19.2.4. If it is understood that the situation narrated by the student is subject to refund, the value of this refund will be the average of the values considered fair by each of the evaluating tutors.

19.2.5. Payments made through bonus credits will only allow refund in this same modality, as already clarified in item 4.7.

19.2.6. All parties, student and tutor, have access to the entirety of the opinions formulated, after the dispute process is completed.
